兩岸專利代理機構營運及績效比較－以將群、三友及三環為例

Abstract

隨著中國政治經濟地位的提升，中國專利的價值隨著水漲船高，龐大的專利申請市場，使中國專利代理機構如雨後春筍般蓬勃發展。對台灣而言，台灣廠商在選擇專利代理機構時，由於兩岸之間無語言障礙，等於有更多供應商可供選擇，除了委託大陸專利代理機構申請大陸專利之外，甚至將台灣專利的申請業務亦委託其代為撰寫。台灣的專利代理機構，在面對大陸專利代理機構來勢洶洶的挑戰，應如何因應？本文擬透過經營管理構面的分析，以台灣將群、北京三友、及廣州三環為例，透過專利產量、獲證比率、目標客群與人力結構等指標，探討專利代理機構在營運管理之績效。期讓台灣對於中國專利代理產業有更深入的瞭解，以利進行相關決策。

China patents are becoming more and more valuable due to the accelerated development of its economy, therewith creating a blossoming patent agency system to satisfy the market demand. Contrary, Taiwan companies have, due to the language vantage point, alternatives in choosing a patent agency to file patents in either Taiwan or China; the choice can either be a local patent agency or a Chinese patent agency across the strait. Due to this penetration of the Chinese patent agencies into the Taiwan patent prosecution system, the local market share in patent prosecution has been precipitating. What should Taiwan patent agencies do to counteract these challenging circumstances under an enterprising Chinese patent agency? Based on an analysis of the operating ambit amongst the JC IP Group, LLC., Beijing Sanyou Intellectual Property Agency Ltd., Scihead Patent Agent CO., Ltd, by using “patent filing volume”, ”patent approval rate”, ”target client” and ”human resources” as a criteria to grade running performances. We, herewith, provide an advanced and extensive analogy of the Chinese patent agent industry to enable Taiwanese patent agencies to strategize.
