技術標準與專利佈局策略之研究---以國內無線通信技術研發為例

Abstract

本研究藉由無線區域網路(Wireless Local Area Network，以下簡稱WLAN)的專利分析，提出相關技術評估之項目；並進而探討新興無線技術標準之專利與技術趨勢，以利我國研發單位在此佈局及策略之推行。\\r 本研究主要發現WLAN技術標準之專利揭露策略比例皆偏低、在專利變化趨勢上多以信號傳輸、網路介面及資料移動的計算為主；而新興無線技術則朝向網路拓撲及服務與安全技術的發展。另外關鍵WLAN晶片的專利及利潤皆掌握在Intersil、Agere及Broadcom等主要廠商中，國內業者應盡快加入國際授權團體以降低侵權的危機；而新興無線技術的參與及積極投入標準的制訂，將是提升研發技術、國際競合能力及取得技術與市場的關鍵要素。此外，主流標準的背後潛藏著無窮的利益，當越多成員支持時越能形成之，故國際標準組織對於所屬標準的專利應要求企業明示，以免落入防礙通訊與經濟進步的專利權爭訟困境。

By studying the patents of Wireless Local Area Network(WLAN), then comparing with the upcoming one of IEEE 802.11n and IEEE 802.16, we have come to recognize some fundamentals that make it stand out as a dominant for technical and patent strategy for the R&D. These fundamentals are summarized as follows: The ratio of patent indicated in the WLAN standard is low. And the method of signal transmission, network and data moving is the main claim in the IEEE 802.11a/b/g patents；while the new trend of patents of IEEE 802.11, 802.16 emphasize the network topology and QoS, that our R&D cannot ignore. Further, the key profit owned by Intersial, Agere, and Broadcom in the WLAN chipset area. So, it’s important to attend the new technical and standard develop group, and to join the international licensing group to reduce the patent suit. For the IEEE 802.11n, 802.16, we should put more effort inside, and gather the update technical and trend information to be the base line of new R&D technology. Finally, for those who want to direct the formation of a standard and get the tremendous potential profits from it, they will do a lot of lobbying and form strategy alliances to attract more supports for the standard. To avoid patent suit, the IEEE should call for all standard-supporting companies to claim all relate patents in advance.
