摘要: 中國法律對互聯網這一新興媒體上自由流動的信息和表達提出了較為嚴格的要求,政府的有關機關也在貫徹這些法律規定方面花費了大量的人力物力,以保證它們能夠在現實生活中得以全面實施。這些法律規定實際上還是把互聯網等同於傳統媒體,就像對待傳統媒體一樣來對待互聯網;在某些方面,對網絡信息傳播的監管和限制,還超過了對於傳統媒體的監管和限制的力度。由於傳統媒體作為獨立的政府制衡機構的概念在中國並不存在,互聯網潛在的政治意義變得十分突出。它構成了一種新的傳播方式,為公民提供了互動的、非等級制的和全球性的媒介,以及繞過施加於傳統大眾媒體的束縛和控制的能力。作為仍在發展中的參與性最強的大眾表達方式,它應該受到更大的鼓勵,獲得更大的空間。為此,對網絡言論表達的限制,應該明顯低於對傳統媒體的限制。
In order to strictly control the free flow of information on the Chinese Internet, Chinese government enact a set of laws and regulations which treat the Internet in the same manner as traditional media and, on some occasions, harsher on the Internet than on the traditional media. The author argues that because of the lack of the watchdog media in China to counterbalance the government power, the Internet has a huge potential to bring about a particapatory political culture. As an empowering medium which is still under a lot of developments, the Internet should be guaranteed a freer space for expression.
