dc.description.abstract在廣告規範的討論上,菸品廣告可以說是相當具代表性與爭議性的議題。本文主要處理的爭點在於,針對我國現行法對菸品廣告限制的規定,究竟是否涉及違反憲法對人民基本權利保護的問題。藉由對言論自由權、財產權與工作權等基本權利的探討,本文認為目前對菸品廣告的限制規定並未逾越憲法所保障人民基本權利的範圍;此外,全面禁止菸品廣告的規定亦屬合憲範圍。
