20世紀德國法學方法論之研究

Abstract

本研究計畫在於探討德國20世紀法學方法論之發展軌跡，即去討論利益法學是在怎樣的歷史背景之下產生，其提出怎樣的命題來更新之前的法學方法論，而評價法學做為利益法學的後繼者，承接了利益法學的哪些觀點，並對其提出怎樣的批判，在這樣的批判之上建立了怎樣新的方法。

This project is a study on the Germany’s key legal methods in 20th century, also the jurisprudence of interest and the jurisprudence of valuation. First it would like to discuss the history developmental contexts of these two legal methods, second analyze their main theses and conception of law, and at last describe their effectiveness and influences. In general, this project tries to provide an integral picture of the Germany`s key legal methods in 20th century, also the jurisprudence of interest and the jurisprudence of valuation.
