摘要: 保險事故發生後,保險人遲延給付保險金乃常有之事。相對於此,保險人主動給付保險金者,甚為少見。本文所評釋之臺灣高等法院101年度保險上字第6號民事判決事實,正為保險人主動給付保險金之情形。在該案中,保險人主動給付主約保險金,乃係為儘快終結其與被保險人之所有契約關係,以規避將來附約可能產生之鉅額醫療給付。另一方面,被保險人遲遲不請求主約保險金,則係希冀繼續維持契約關係存在,藉此享有附約所提供之醫療給付。從而雙方當事人皆有不誠信情事,如何評價其民事責任?本文將以民法誠信原則為中心,重新檢討本案主約與附約間契約效力之關聯。
When insured event has been occurred, it`s usual for insurer default on insurance payment. Instead, it`s unusual for insurer to offer insurance payment promptly. The fact of Taiwan High Court Civil Judgment Boaxian-Shan-Zi No.6 (2012) commented by this article, shows that insurer promptly pays insurance payment. In that case, the insurer desires to end all contractual relationship with the insured, so she promptly pays master insurance policy`s money for avoiding huge medical payment arising from rider. On the other hands, in order to keep contractual relationship with the insurer, if insured defaulted on master insurance policy claim, and then takes medical payment from rider. Consequently, both parties act in bad faith, she how to evaluate their civil liability? This article will reexamine the connection between master insurance policy and rider by principle of good faith.
