中國大陸反不正當競爭法之研究

Abstract

大陸在順應市場經濟體制發展而頒布施行的反不正當競爭法，儘管在對市場經濟秩序的規範有一定的作用並積累出執法經驗，但在面臨市場經濟更進一步開放的同時，必然又對於自身經濟體制中有關行業性壟斷的牴觸與挑戰，致使大陸在對於反壟斷法的立法提出呼籲。即使在反不正當競爭法的執法中在面臨經濟發展的加劇，新的競爭秩序與型態層出不窮，既有的法律規範亦嫌不足，致使行政主管部門必須以配套法令作為因應。大陸在經濟發展的過程中，一向以「政府型推動改革」作為主導，當經濟發展中所出現的新型態競爭秩序超出政府所能掌握的情事，加諸加入WTO所面臨的變化與挑戰之際，既有由國家控制主導的傳統觀念仍根深蒂固，要使市場有效運行，便必須取消這些不利於競爭的規則與作法，這些努力必須以對壟斷訂定規章制度和制定反壟斷法作為補充，從而確保公平競爭效益與秩序，不應以淺層次地以現行法規為已足。

The ”Law of the People`s Republic of China Against Unfair Competition,” promulgated by Mainland China to be in conformity with the development of market economic mechanisms, has standardized the market economy order to some extent and accumulated certain experience in implementation. Facing the further opening of market economy, however, this law will, at the same time, contradict and challenge the related industry monopoly of its own economic mechanism, thus bringing about more appeals for antimonopoly legislation. Since there will surely be endless new competition orders and ways came from rapid economic growth, the ”Law of the People`s Republic of China Against Unfair Competition” will no longer be efficiently implemented, thus pushing the authorities to feel the need to promulgate complementary laws and regulations. During the course of economic development in Mainland China, the Chinese government has been playing an important role in pushing forward economic reforms. When the new competition orders and ways emerged from the rapid economic development (such as the changes and challenges after China`s entry into WTO) go beyond the government`s control all regulations and practices hindering fair competition will need to be totally abolished. Moreover, laws and regulations concerning monopolies shall be promulgated, making an overall endeavors to assure the benefits and orders of fair competition. We should not be content with the presently in existence imperfect laws against unfair competition.
