從華為案看美國管制高科技產業的國安考量

Abstract

本研究從華為個案看美國出於國家安全管制高科技產業的考量。華為是全球前三大的5G電信設備供應商，本研究從美國制裁華為個案之歷史脈絡發展分析，並對應美國5G國家安全戰略，以及該個案衍生的美國行政、立法措施，乃至於國際上的倡議效果。\n\n本研究從文獻上綜合研究美國維護國家安全的核心。美國是如何將國家安全核心考量化為戰略，並將戰略落實在行政與立法措施的實際行動、公共政策上。希望從研究與了解美國維護5G國家安全的經驗上，將作為我國政策、制度健全之參考面向。

This study aims to illuminate U.S. considerations regarding national security regulations for high-tech industries based on the case of Huawei, one of the Global top three suppliers for 5G telecommunications equipment. The course of events leading up to U.S. sanctions on Huawei and subsequent developments will be analyzed in this study. Moreover, the U.S. corresponding national security strategy for 5G, U.S. administrative and legislative measures related to the case, as well as the effect of international advocacy will also be examined.\n\nThis study draws on existing literature to summarize and investigate the core tenets of the U.S. protection of its national security. It studies how the United States forms strategies based on considerations of these core tenets and further implement the strategies in actual administrative and legislative measures as well as public policies. The U.S. experience in protecting national security under the 5G context will serve as valuable reference for our nation to refine current policies and institutions.
