電信市場自由化以來，如何突破網路型產業自然獨占的特性，擺脫市場壟斷宿命，使消費者擁有更多更好的選擇，為各國管制機關所廣泛認同的目標。為了達成此一目標，「不對稱管制」即針對原獨占電信公營事業或機關單位的優勢地位，採取特定的管制措施，以避免新進業者參進市場時居於不利地位，進而減損市場趨向競爭的可能性。隨著自由化逐步推進，歐盟的電子通傳架構指令導入競爭法原則，將不對稱管制課予限於「市場未具有效競爭」的前提，認定上的方法論與競爭法的分析原理介接，並明確指出目標是能夠在市場轉向有效競爭，回歸由競爭法管制的目標。由於我國最新於2019年所通過的電信管理法中的不對稱管制，係參照歐盟電子通傳架構規範，本文除探討歐盟相關指令規範與英國國內法化的規定外，並以Ofcom於2020年1月所公布的固網市場重新界定諮詢文件為例，對應機關於適用與執行法規上的理解。本文希冀能以法比較的思維，完備不對稱管制體系的框架性思考及其內涵與意旨，以期能增進我國未來於不對稱管制操作上的精確性。
