公平交易法之註釋研究系列（三）：第二十五條至第四十九條

Abstract

「公平交易法之註釋研究系列」乃是進行本國公平交易法之註釋書撰寫工作，藉以提供政府、學術專家以及實務工作者處理公平交易案件及後續研究之參考。在體例上，係參考外國法條註釋書編寫方式，並參證國內推動重要法典逐條註釋之既有經驗，期以系統化方式整理、呈現我國學說及實務之發展情形，並有效扣合法律專業工作者援引、解釋公平交易法之操作需求。 由於法條註釋書之編寫方針，係以系統化之方式，揭示現行有效法律之意義及其規範內容為目的，尤重法條規範目的、構成要件、法律效果以及如何適用之闡明；因此，「公平交易法之註釋研究系列」之註釋體例，除法律條文之文義、條文結構及各條間之相互關係、相關法律概念之比較參照之外，具體個案中有權機關之解釋及其適用之情形等，尤其為個別條文之註釋重點所在。此外，為有助於我國快速累積競爭法之立法經驗、執行技術與執法能力，「公平交易法之註釋研究系列」於體例的安排上，於各該條文之構成要件註釋前即先進行外國相關法制比較，而檢選本國立法過程中曾經參酌之美國、日本、德國的相關規定，以及近來廣受矚目並為國內學說與實務所重視的歐盟法制，作為法制比較之參考。 本次研究報告內容，係「公平交易法之註釋研究系列」第三部份。除於序論中再次說明「公平交易法之註釋研究系列」逐條釋義之撰寫體例外，本次註釋範圍為公平交易法第二十五條至第四十九條，亦即以公平交易法第四章（公平交易委員會）、第五章（損害賠償）、第六章（罰則）與第七章（附則）為註釋內容。 The project regarding ？§The Annotation of the Fair Trade Law？？ intends to provide a profound reference book and help the government, scholars and enterprises to cope with the cases related to the Fair Trade Law. Hence, this project tries to expound the theories and practice with regard to the Fair Trade Law. Follow-up researches are also supposed to be boosted by this project. ？@？§The Annotation of the Fair Trade Law？？ volume 3 is comprised of the preface and the annotation of the Articles classified in Chapter 4(Fair Trade Commission), Chapter 5(Compensation for Damages), Chapter 6(Punishment), Chapter 7(Supplementary Provisions). As for its style, with consulting foreign annotation books and the previous related experiences in Taiwan, ？§The Annotation of the Fair Trade Law？？ also emphasizes the purpose, elements, effects and application of each article, and especially focuses on the interpretation of the competent authority. Moreover, for improving the experiences and abilities of enforcing competitive laws, ？§The Annotation of the Fair Trade Law？？ introduces the relevant regulations of United States, Japan, German and the European Union prior to the annotation of each article.
