摘要: 中國大陸婚姻法於二OO 一年四月二十八日作大幅度之修正,本研究計畫主要以中國大陸婚姻法中新修正之夫妻財產制為研究對象。茲就計畫要點分析如下:1.夫妻財產制之修正背景;2.新夫妻財產制之立3.法定財產制:(1)採婚後所得共同制之立法背景;(2)夫妻共同財產制之範圍;(3)夫妻對共同財產之權利義務;(4)法定財產制關係之終止:A.終止之原因;B.終止後之效果;4.特有財產:(1)特有財產規定之背景;(2)特有財產之範圍;5.約定財產制:(1)約定財產制之立法意義;(2)約定之方式;(3)中國大陸約定夫妻財產制之種類;6.結論。
The Chinese Law of Marriage was modified substantially in April 28 of 2001. It`s been the main theme of this research plan to focus on the study of spouses` property ownership as provided by the newly modified Marriage Law. Amongst the related issues, the followings are the major topics to be covered: 1. The Background of the Modification Relating to the Spouses` Property Ownership; 2. The Legislative Principles of New Rules; 3. The Spouses` Property Right System as Provided by Law: (1) The Legislative Background of Community Property System in regard to The Property Gained after The Marriage; (2)The Scope of Community Property; (3)The Spouses` Right & Obligation to the Community Property; (4)The Termination of The Enacted Property System: A. The Causes of Termination; B. The Legal Effects to The Terminations; 4. The Absolute Property: (1)The Legislative Background of Absolute Property; (2)The Scope of Absolute Property; 5. The Property System by Agreement: (1)The Legislative Background; (2)Methods of Agreement; (3)Types of Agreement; 6. Conclusion.
