摘要: 我國核廢料處理在「低放射性廢棄物最終處置設施場址設置條例」(以下簡稱「場址條例」)通過、引進公投機制之後,進入一個新的時代。以往被質疑為黑箱作業的選址流程,現在則因為公投的實施,而給予地方居民參與決策的正式管道。居民參與誠為解決鄰避設施爭議的重要原則,但公投同樣可能成為政治人物操弄民粹的利器。此外,我國不但剛頒訂「場址條例」,以往也未有地方公投的實施經驗,故選址過程所涉及之不同法律體系間的競合關係,也尚待釐清。因此本研究希望透過法條解析、跨國比較研究、以及地方政治生態等面向的調查,為順利完成具公信力的高品質地方公投,提供細部制度規劃與實施策略的政策建議,不但解決選址的爭議,也為我國審議式民主的實施,樹立典範。 It has been a new epoch for the siting gridlock in Taiwan since the introduction of the plebiscite in the administration procedure by the newly enacted “Regulations for the Siting of the Low-Level Radiation Waste Repository” (hereafter the “Siting Act”) in 2006. Although public participation has widely been recognized as a core principle to manage Not-in-my-back-yard syndrome, tools like plebiscite are also notorious for their populist effects associated with political manipulation. This study therefore aims at controlling negative effects of the plebiscite and streamlining the procedure by analyzing the conflicts of germane regulations, investigating local political ecology, and comparing similar experiences abroad. The study will offer practice suggestions on institutional fine-tuning and strategic choices for policy implementation
