不當勞動行為實體法與程序法整合型計畫-裁決程序子計畫 (I)

Abstract

在整體有關不當勞動行為之整合研究中，本子計畫將聚焦於我國勞資爭議處理法新法中所制定之裁決程序，分別就有關裁決程序之理論、裁決委員會之組成與運作、裁決之審理、裁決決定之內容等四大部分，分別進行理論與實踐面向的探討，以便建立我國不當勞動行為制度程序處理體系之具體內涵，以利將來之法律適用。

In the total integral research project about the so-called unfair labor practice and remedial system, this subproject would like to put its focus on the procedure of decision within the Law for Settlement of Labor Disputes Taiwans with its modified edition since June 2009. The following issues should be, in its theoretical and practical dimension, described and analyzed: theoretical aspects of the procedure of decision, organization of the committee for decision, procedure of trial within the decision making and not the least contents of decision. This subproject will provide a foundation to establish the system and the concrete contents for the procedural side of the institution unfair labor practice in Taiwan, which shall make a great help about the legal application in labor life.
