日期: | 2012 | 上傳時間: | 1-Nov-2013 | 摘要: | 計劃經濟時期，中國大陸採取父權主義的制度安排，對勞動權利的保障進行規範。在此一體制下，國家透過行政手段直接介入勞動關係的管理，城市勞工的個人權利可以說是受到國家全面的照顧，不僅可以得到工作上的保障，還享有工作單位所提供的各項社會福利。市場改革後，國家不再提供勞工全面的父權主義照顧和保護，這樣的體制逐漸遭到摒棄。為了符合市場經濟的運作，政府制定了一系列的法規，建立一個「以法律為基礎」的勞動體制，試圖重新界定和建構勞工的權利，而國家對於勞動關係的管理也從行政上的控制轉變為法律上的管制。\n\n 本文旨在嘗試以政策變遷的觀點來分析中國大陸勞動體制的變革，並運用Peter Hall政策典範的概念，分析勞動體制移轉的過程，同時也作為檢視勞動體制變遷程度的依據，過程中，除了探討中國大陸從計劃經濟到市場經濟的勞動體制變化，亦將說明中國大陸勞動權保障的演化。對此，本文指出在市場經濟下，中國大陸勞動體制發生了典範移轉的現象，「以法律為基礎」的體制取代了「國家父權主義」的體制，一方面，工作權的部分，國家不再負責提供就業機會，而是轉向促進就業的工作，勞動力的配置則改由市場機制決定，勞動者重新獲得自由選擇職業的權利；另一方面，勞動三權的保障仍舊受到相當程度的限制。 | 參考文獻: | 一、中文部分\n專書\n王文科，教育研究法，第7版（台北：五南，2002年）。\n王全興，勞動法（北京：法律出版社，2006年）。\n王春光、單麗卿譯，Dorothy J.
