摘要: IT產業的智慧財產經營佈署和研發策略的擬定,已不比過去走一步算一步的日子。大型的專利訴訟與國際大廠爭相推動制定技術標準,IT產業也隨著跨入新的時代。台灣廠商看好大陸地區之優質研發人才,而不斷前往大陸設立研發中心,兩岸在高科技產業的互動與競合上,也已進入智慧財產保護及研發策略的新紀元。本研究利用大陸參訪之機會進行個案的實地訪察,參訪全球性工業電腦龍頭廠商-研華科技,以及大陸IT產業軟體排版龍頭廠商-方正集團。並針對個案對智慧財產保護之積極性與差異性進行分析比較。並得出結論為,大陸廠商對智慧財產保護、管理之觀念與積極度已不可同日而語,在專利與技術標準之結合亦有所認知,且擁有中國廣大的市場及舞台,台灣廠商不可不慎,須善用自身技術創新能力與品牌經營之優勢,並建立完善的智慧財產保護與管理機制,掌握企業之競爭優勢來源-核心能耐,將IP之價值與效益發揮至最大。
Unlike the passive thinking of the past, the IP management and R&D strategy of IT industry nowadays play a different role. The battle of IT industry is changed regarding to the launch of several large-scaled patent litigations and the devotion of big companies upon standard-setting, . For cheaper and better innovative human resource, Taiwan companies gradually move to China and set up their R&D centers there. The cooperative/ competitive interaction between cross-strait IT industries is also entering into a brandnew era.This study focuses on the comparison between two cross-strait companies, Advantech corp. and Founder Group. Each of them represented key player in IT industry of Taiwan and China, with their core competencies upon “industrial PC” and “software typesetting“, respectively. This discussion is developed from their perspective of IP protection and management. The attitude of China IT industry upon IP protection and exploitation is no longer as passive as usual. The market in China possessed enormous potential, and now the importance of combining patents with industry standard is highlighted to maximize its own good. From Taiwan’s perspective, it’s crucial to utilize and extend the strength of innovation and brand value, which brings substantial competitive advantage. From these cases, the priority for Taiwan companies is establishing in-house IP management process, in order to fully perform the value of intellectual property.
