拉丁美洲原住民族權利發展─兩次原住民族國際十年期間（1995-2014）

Abstract

本文從1989 年國際勞工組織修正『第107 號公約』，『原住民和部落人民公約』（第169 號公約）出現，經過1993 年聯合國宣布國際原住民年，1995 年推動第一個世界原住民族國際十年，接著2005年再推第二個國際十年行動綱領，更在2007 年通過『原住民族權利宣言』，一直到2014 年結束兩個國際十年。本研究檢視『第169 號公約』以降，聯合國『原住民族權利宣言』的發表，推動兩個國際十年期間，拉丁美洲國家原住民族權利發展的狀況，特別是考察實際推動層面值得借鏡之處。

The present study examines the influence of the ILO Convention 169 and the UN Declaration on the Rights of Indigenous People on the protection of indigenous right in Latin American countries during the two International Decades of the World’s Indigenous Peoples. While observing those developments from 1995 to 2014, we make efforts to understand the actual situations in these countries and seek to see any lessons that have been learned.
