日期: | 2002 | 上傳時間: | 9-May-2016 | 摘要: | 本論文首先大致分類原住民族傳統資源為「傳統知識、民俗文化、遺傳資源」等三領域；而其所面臨之困境又可分析為「法律、經濟、權力主體」三項因素。\r\n 接著以三個章節之內容分別描述「民俗文化、傳統知識、遺傳資源」之名詞定義、保護現況、所面臨之智慧財產權問題及可能之相關新興法案。\r\n 最後，分別從「法律、經濟及權力主體」三方面提出因應之道，以合理規範原住民族傳統資源之商業運用及權利歸屬。 First, we can classify Indigenous Traditional Resources into three sectors in this dissertation: Traditional Knowledge, Folklore and Genetic Resources. We can analyze the predicament through three viewpoints: Law, Economy and the\r\nAuthority.\r\n Second, the content of chapter 4、5、6 describe the definition, current situation, IPR problems and the related new acts that might be.\r\n At Last, we propose a policy based on the three viewpoints mentioned early in order to reasonably regulate the ownership and rights of business use of Indigenous Traditional Resources.
