關於未成年人之法律行為

Abstract

本文之旨在於探討有關未成年人法律行為之相關問題，包括行為能力制度之規範目的、代理權授與行為、代理行為瑕疵、法定代理人贈與移轉財產於未成年子女、法定代理人之允許或承認意思表示錯誤、向限制行為能力人為意思表示之生效時期、限制行為能力人與善意取得、限制行為能力人對於特定財產之處分能力以及相對人之催告權等相關問題。

This article aims to discuss issues that relate to juridical acts of minors, issues including the purpose of the laws having the capacity to make juridical acts, juridical acts that confer authority of agency, defects of delegated acts, the transfer of property from the guardian of a minor child to the child as a gift, mistakes in the expression of approval or acknowledgement of the guardian of a minor child, the effective time of the expression of intent to a person limited in capacity, acquirement of property in good faith by a person limited in capacity, the ability of a person limited in capacity to dispose of specific property, and the right of the other party of a contract to request the guardian to answer whether he acknowledges the contract or not.
