摘要: 內政部於二○○七年一月提出「國土計畫法」草案條文共五十四條規定,擬作為我國未來國土最高之計畫指導原則,藉以填補我國現行法缺乏國土基本法,並成為指導都市計畫與區域計畫之法律依據。但是不論草案有關其定性與效力、適用範圍、分類、指導原則、審議委員會、民眾參與、中央與地方權限衝突之解決、功能分區、罰則、既存權利之調整及國土永續發展基金之設計,均尚有諸多值得商榷之處,本論文乃分成十二個次主題,對草案內容之妥當性及合理性作全盤評估,並提出本文之修正意見,希望我國未來國土法草案能完成其預設目標,而非僅僅淪為二代區域計畫法而已,使得其良法美意未能發揮其功能。
In January 2007, Ministry of the Interior proposed a legislation draft of “Act of National Land Plan.” 54 articles in the draft are our nation’s future sketch and top principles on soil plan to complete our current shortage of such law and set as a legislation model for metropolitan zoning and regional plan. However, there are many issues remain controversial in the draft, such as its qualification and validity, scope of application, characterization, instructing principle, review committee, participation of citizen, resolution of conflict between the central and local government, zoning, penalty, adjustment of vested rights, and design of the funds of Continuing Development of National Land. Based on these issues, this thesis is presented in 12 subjects to completely assess if the draft is appropriate and reasonable and raise suggestion on amendment. The author hopes that this draft will accomplish its intended goals instead of merely being a secondary zoning plan act which detaches from its original fine purposes.
