dc.description.abstract雖然我國於二○○三年增訂傳聞法則,不過刑事訴訟法第一五九條之一卻不屬於任何英美法上的傳聞例外類型,以致於學說上常批評該條規定違反對質詰問權之保障。實務上雖然大法官釋字第五八二號解釋已排除該條規定於共同被告於審判外陳述之適用,不過最高法院對此卻存在不同的觀點。本文以傳聞法制之沿革目的為基礎,除檢討最高法院相關裁判外,亦在探討我國傳聞例外之法理基礎。
dc.description.abstractSince Taiwan adopted hearsay, Article 159-1 of the ROC Criminal Procedure Code goes much beyond hearsay exceptions of Anglo-American hearsay, which has resulted in academic criticism of confrontation-right violations. Even the Grand Justice Interpretation No. 582 already excludes that article from out-of-court statements made by the co-conspirator; the Supreme Court opines different viewpoints on this point. In addition to analyzing cases of the Supreme Court, this study searches for the rationale of hearsay exception of the ROC Criminal Procedure Code based on the development of hearsay in the Anglo-American legal system.
