| dc.description.abstract (摘要) | 本研究計畫主要研究重點有二： 1、國土計畫法立法通過前，既有的都市計畫法、區域計畫法土地規劃法規，是否足以因應國土規劃之需求？ 2、國土計畫法立法通過後，該法與既有的國土規劃法規相互關係如何？新法是否能完整涵蓋舊法適用範疇，新舊法間若有互相矛盾衝突，應以何法為優先適用？ This project is bond to achieve the following preliminary goals, (i)Whether the pre-existing national land administrative laws (Regional plan act and Urban planning act) suffice the needs for implementing the scheme of national land planning, prior to the enforcement of the National Land Use Act ,and (ii)After the enforcement of National land use act, what is its relationship between the pre-existing statutes mentioned above, and (iii)Whether the new National Land Act is capable of substituting the pre-existing laws, and (iv)If contradiction occurs while applying the new act and the previous laws, should there be a priority between them. | en_US |
