| dc.description.abstract (摘要) | 自由心證主義係民事證據法中關於法官認定事實之核心原則，其對於法官認定事實給予一定程度彈性空間，而得避免因僵化法定證據原則，造成具體個案上難以實現真實發現之訴訟法理想。但因此一原則有較為不明確之內涵，容易造成誤解，若操作不慎，其對於法治國原則所要求之法律安定性及法官依法裁判之原則，極易形成威脅，司法公信力經常因此而受到挑戰。我國學者對自由心證主義已有所注意，其研究成果甚值重視。本研究擬在國內既有研究成果之基礎下，引介德國、奧國及瑞士等國之法學者思想及其實務操作成果，並對於我國實務上判決及實務家之思考背景與方式，進行本土性實證研究及比對，用以尋得自由心證主義在我國被濫用或污名化之原因，並探求解決之途徑。 | en_US |
| dc.description.abstract (摘要) | In civil evidence law, the doctrine of free evaluation of the evidence is the key principal, which provides some flexibility for judges to affirm facts and can avoid the rigid legal evidence principal to block the purpose of civil procedure law in discovering the objective truth. However, this principal is easily caused misunderstanding because of its ambiguous contents. If judges abuse this principal, it may threaten the essential foundations of the legal stability under rule-of-law principal and the principal of judge by law and therefore make the judicial faith be challenged. The scholars in Taiwan have paid attention to 「the doctrine of free evaluation of the evidence」 and delivered some valuable research articles. This article not only introduces relevant theories in Germany, Austria and Switzerland and the judicial practical results of those countries, but also compares our domestic legal research with domestic judicial verdicts and relevant ways of thoughts of the judges. Through the legal research, this article hopes to find out the reasons why the free evaluation of the evidence principal is abused and notorious in our country, and figure out the solution as well. | en_US |
