題名 社群網路時代的合理隱私期待概念:兼論我國法制現況

摘要 美國聯邦最高法院Harlan 大法官於1967 年Katz v. United States 一案之協同意見中首度提出「合理隱私期待」之概念,作為判斷政府行為是否構成「搜索」之標準。迄今,此一概念不但被聯邦最高法院奉為圭臬,影響所及甚至包括侵權行為法與刑法侵害隱私責任等領域,於隱私權保障上實具有重要之地位。然而,「合理隱私期待」之概念仍有值得檢討之處。學者即曾指出美國聯邦最高法院與一般民眾所認知的隱私期待存有相當落差。此外,由於此一概念最終取決於社會通念,可能受到社會多數人意見之左右,造成隱私權之萎縮。更有甚者,近年來社群網路興起,民眾透過臉書等社群網站傳遞、分享大量之個人資料,從「合理隱私期待」概念之角度,應如何看待此一現象?尤其此類社群網站往往結合雲端運算科技,使用者將個人資料儲存於遠端伺服器之結果是否影響其隱私期待?法制上應如何因應?凡此問題,均值得加以研究。本計畫之目的即在檢視「合理隱私期待」概念之發展軌跡,瞭解此一概念之侷限,以及其在社群網路、雲端運算時代所面臨之問題,並就我國目前適用此一概念之情形進行整理分析,俾供將來學術討論及實務參考。
In his concurring opinion in Katz v. United States, Justice Harlan proposed a two-step “reasonable expectation of privacy test” in order to determine whether the disputed government action constituted a search. And the test later became the gold standard for the Supreme Court’s Fourth Amendment cases. The influence of the reasonable expectation of privacy test, however, extends beyond the constitutional law; the test plays a key role in the fields of privacy torts as well as privacy protection statutes. Nevertheless, scholars have long pointed out that the test suffers from several problems. First, empirical studies showed that there was a big gap between Supreme Court’s decisions and society’s understandings of whether a reasonable expectation of privacy exists. Moreover, as one scholar suggested, since privacy ultimately turns on expectations that society considers reasonable, “the government could gradually condition people to accept wiretapping or other privacy incursions, thus altering society’s expectations of privacy.” Most importantly, in recent years, social networking sites, like Facebook, have attracted lots of users, and they post huge amount of personal information on these media. Do people still have a reasonable expectation of privacy regarding the information they share on the social networking sites? Does the fact that the personal information posted on these websites is stored on remote servers using cloud computing technology affect people’s expectation of privacy? The issues mentioned above have not yet been thoroughly studied. This research project aims to comprehensively review the development of the notion of reasonable expectation of privacy, its doctrinal limitations, and its applications in the age of social networking and cloud computing.
