摘要 本研究之研究目的,主要從法制面與教育面,探討台灣公立中小學實施教師定期異動制度之議題。首先依照學說及法院實務判決,論證公立中小學教師具有實質公務員身分;並基於憲法理論,為保障教育資源均衡請求權、學生教育平等權及教師工作權,說明台灣實施教師定期異動制度有其法理上之依據。此外,本研究亦參酌日本與韓國實施教師定期異動之現況,發現兩國均視異動為手段而非目的,必須兼顧教師生活安定性,故宜循序漸進推動此制度。具體建議為定期異動期間以三至六年為宜;異動區域劃分原則應考量教師居住地與交通距離等因素;為利學校特色發展,得授權校長申請展延教師異動期限;政府應提供相關獎勵機制,鼓勵教師申辦教師定期異動制度;與設置縣市層級委員會,統籌規劃辦理教師定期異動制度等。希望能做為未來《教師法》及《國民教育法》修法參酌方向,並提供教育行政主管機關未來相關政策擬定之參考。
The main purpose of this paper is to examine the proposal for the elementary and secondary teacher transfers program between schools in Taiwan. From legal and educational perspectives, the study first reviewed the legal status of the teachers and current teacher transfers policies in Japan and Korea while focusing on identification of the factors associated with the feasibility of the program. The findings indicated that administrative issues, traffic concerns, and motivational factors could have strong influence on the policy decisions to support the implementation of the teacher transfers proposal. Also, the study provided insight into approaches for promoting teacher transfers within their school districts and suggested that legal and administrative changes should be made to strengthen the practicability of the proposed teacher transfers program in Taiwan.
