摘要: 本文嘗試以寓言觀點詮釋歌德的《浮士德》,反思法律與文學的交匯與分歧。換言之,本文將《浮士德》解讀為一則法律寓言。主要論點是:魔鬼梅菲斯特擁有眾多可以比擬為現代法律的特徵,浮士德則象徵必須藉由法律實現需求的人。魔鬼因浮士德的欲望而來,也驅動浮士德的欲望。這如同人為了實現需求而創設法律,法律反而促生新的需求。此外,本文提出《浮士德》是緊扣憂愁(Sorge)的文本。悲劇第一部中,浮士德最初因欲望無從實現而憂愁,所以招致魔鬼(也就是法律)現身。浮士德不停地倚賴魔鬼以滿足欲望,卻加劇自我的分裂,甚至與魔鬼同化。現代法律實現人的需求,卻又使人無從自欲望解脫。悲劇第二部中,擬人化的憂愁吹瞎浮士德雙眼,則寓指我們對於法律的這些弔詭視而不見,憂愁於是成為人對於現代法律秩序的反省。
Reflecting the convergence and divergence between law and literature, this paper attempts to interpret Goethe`s Faust from an allegorical perspective. In other words, the study reads Faust as an allegory of law. The main argument is: the Devil is summoned by Faust’s desire and this desire in return propels him. In this regard, Mephistopheles, the Devil in Faust, could be perceived as representation of modern law, while Faust symbolizes the man who has to realize his needs through law. Secondly, this study claims Faust is also a text of Sorge. In the first part of the tragedy, Faust`s Sorge derives from his unquenchable desires, on which occasion the Devil (the law) makes his debut. Faust also constantly relies on the Devil to satisfy his desires, eventually leading him to disorientation and even assimilation of the Devil within himself. Law fulfills our needs, but makes us even less free from our desires. In the second part of the tragedy, Faust went blind because of the personified Sorge, signifying that we are blind to these paradoxes of the law. The paper thus reads Sorge as a critique of modern legal order.
