| Abstract: | 「任何人不得基於他人之損失而有所得利」，此乃基於自然法之公平正義思想演變而成。自希臘大哲亞里土多德氏首倡正義觀以還，學者乃著手探討此一法理之實用。故羅馬法 中關於不當得利原則之揭藥，英美法系中衛平制度之出現，實乃此一理念之高度發揚。降及後世，社會生活雖日形複雜，人事關係雖日趨錯綜，然此一制度之理論，非但未因此而湮沒不彰；且更隨之而大為闡揚，其立論之稍微可知矣。惟如何方能運用此一制度衡情酌理，細無窮之世事，則仍的時後學者努力從事，剖析其奧理，以應現事社會之需也。 |
