摘要 擔保乃保險人用以控制危險之工具，尤其在海上保險，被保險人如違反了擔保，往往遭致比非海上保險更不利益之結果，嚴重性實不容忽視。本論文即在對英美及我國海上保險中有關擔保之法律與條款作通盤的研究，藉以明瞭我國法之缺失及謀求改進之道，全文分為六章，各章內容大要如下:
