題名 服務業貿易障礙及其自由化之研究

摘要 傳統以來，服務業由於其所具有之生產和消費的同步性特徵，使得其一直被視為非貿易財，而常常為國際經濟學者所忽略，甚至國際貿易制度亦一直側重於財貨貿易的規範。
     但近年來，遠距離通訊科技的進步，使得服務業的可貿易性大幅提高，其在國際貿易領域中的貿易量、種類均快速地增加，而不再當然地被視為非貿易財。因此我們不禁要問，服務業所具有的特徵是否會使得其貿易方式、貿易障礙之型態、或決定貿易型態的因素不同於財貨貿易，甚或傳統的國學貿易理論是否可適用於服務業貿易。本文將針對上述這些問題逐一探討，並提出可能之解答。
     關於服務業貿易的國際規範方面，現存之國際組織，或者是針對特定的服務業予以規範，或者是規範的範圍涵蓋全部的無形交易，而鮮少針對全球性服務業貿易加以規範者，所以目前急需建立一套多邊架構以規範之。GATT即是在此一背景下，將服務業貿易納入烏拉圭回合的談判主題之一。
     由於參與談判的己開發國家和開發中國家在服務業的發展程度差異甚大，使得多邊架構的各項談判重點，如談判場合、談判的涵蓋範團及談判目標等，均陷入一南北對抗的局面。本文將詳細敘述南北兩大集團在上述各項重點所持之立場，除此之外，本篇論文將檢視以往有關服務業貿易之國際規範，其中以OECD的兩個自由化法典，值得特別注意。至於現階段正在進行之烏拉圭回合談判，雖未完全閉幕，但已獲至一「服務業貿易總協定」之草案，本文亦將詳細討論該草案內容。
     論文之最後一部份是有關於我國服務業貿易的現況與展望。我國服務業貿易之自由化，除了金融業設有進展之外，其他各業別則大多仍是獨占事業或是國營事業，其自由化仍有待努力。本文僅針對幾個業別的發展現況作簡要之介紹，並提出未來朝向自由化應採之態度及措施。
