歐盟東擴日期 2005 上傳時間 6-May-2016 15:55:44 (UTC+8) 摘要 一九五０年法國外長舒曼總合莫內（Jean Monnet）的主張，在一九五０年五月九日發表「舒曼宣言」(Schuman Declaration)主張各國將煤、鋼資源的所有權移轉給一個超國家（supranational）的機構，由這個機構負責煤鋼的生產。「舒曼計劃」（Schuman Plan）具體建構出超國家組織機構，這個倡議得到了法、德、意、荷、比、盧六國的響應，一九五二年七月二十五日，建立「歐洲煤鋼共同體」（European Coal and Steel Community，簡稱ECSC），開啟歐洲統合之道。 一九九一年十二月十一日，歐洲共同體馬斯垂克高峰會議透過了以建立歐洲經濟貨幣聯盟和歐洲政治聯盟為目標的「歐洲聯盟條約」(The Treaty of European Union)，亦稱「馬斯垂克條約」。一九九三年十一月一日馬斯垂克條約正式生效，歐洲共同體更名為歐洲聯盟(The European Union)。這代表歐洲共同體從經濟實體向經濟政治實體過渡。 二００二年 十一月十八日，歐洲聯盟十五國外長會議決定邀請塞浦路斯、匈牙利、捷克、愛沙尼亞、拉脫維亞、立陶宛、馬爾他、波蘭、斯洛伐克和斯洛文尼亞十個中東歐國家入盟。二００四年五月一日，這十個國家正式成為歐洲聯盟的成員國。 歐洲議會於歐盟體系之角色與職權的變遷並沒有可依據理論模型，為其應屬於實務之議會運作。儘管歐洲議會的職權逐漸擴張，為了回應民意要求改善「民主赤字」問題，歐洲議會得以增強其角色，包括了獲得申訴權力、調查權力與任命行政監督，以及在立法程序中歐洲議會可以利用諮詢程序（consultation procedure）、合作程序（cooperation procedure）、共同決定程序( Co-decision procedure)以及同意合作程序（assent procedure）等四種參與決策的程序，但是仍然有其侷限性， 並不如各國國內一般議會的權力執掌。 筆者想要藉由對使歐洲議會各階段權力增長法源的分析，以及歐洲議會與歐洲聯盟下轄之部長會議與執委會三者對於立法權、預算權以及監督權等各方面職權消長之探討，瞭解歐洲議會的職權是否真正擴張，並對二００四年歐盟東擴與歐洲制訂新憲法等重大議題作一整理探討，以期最後能導出歐洲議會是否真正從一超國家議會，轉變為國家內部議會組織功能。 參考文獻 西文 （一）專書 Amstrong, K. and S. Plan）具體建構出超國家組織機構，這個倡議得到了法、德、意、荷、比、盧六國的響應，一九五二年七月二十五日，建立「歐洲煤鋼共同體」（European Coal and Steel Community，簡稱ECSC），開啟歐洲統合之道。 一九九一年十二月十一日，歐洲共同體馬斯垂克高峰會議透過了以建立歐洲經濟貨幣聯盟和歐洲政治聯盟為目標的「歐洲聯盟條約」(The Treaty of European Union)，亦稱「馬斯垂克條約」。一九九三年十一月一日馬斯垂克條約正式生效，歐洲共同體更名為歐洲聯盟(The European Union)。這代表歐洲共同體從經濟實體向經濟政治實體過渡。 二００二年 十一月十八日，歐洲聯盟十五國外長會議決定邀請塞浦路斯、匈牙利、捷克、愛沙尼亞、拉脫維亞、立陶宛、馬爾他、波蘭、斯洛伐克和斯洛文尼亞十個中東歐國家入盟。二００四年五月一日，這十個國家正式成為歐洲聯盟的成員國。 歐洲議會於歐盟體系之角色與職權的變遷並沒有可依據理論模型，為其應屬於實務之議會運作。儘管歐洲議會的職權逐漸擴張，為了回應民意要求改善「民主赤字」問題，歐洲議會得以增強其角色，包括了獲得申訴權力、調查權力與任命行政監督，以及在立法程序中歐洲議會可以利用諮詢程序（consultation procedure）、合作程序（cooperation procedure）、共同決定程序( Co-decision procedure)以及同意合作程序（assent procedure）等四種參與決策的程序，但是仍然有其侷限性， 並不如各國國內一般議會的權力執掌。 筆者想要藉由對使歐洲議會各階段權力增長法源的分析，以及歐洲議會與歐洲聯盟下轄之部長會議與執委會三者對於立法權、預算權以及監督權等各方面職權消長之探討，瞭解歐洲議會的職權是否真正擴張，並對二００四年歐盟東擴與歐洲制訂新憲法等重大議題作一整理探討，以期最後能導出歐洲議會是否真正從一超國家議會，轉變為國家內部議會組織功能。 zh_TW dc.description.tableofcontents 目錄
