| dc.description.abstract (摘要) | The decentralization of administrative power is not a novel phenomenon in the modern state. The Principle of Democracy does not demand the maximum level of democratic legitimation for decisionmaking, but rather a sufficient level of legitimation. The sequence of responsibility may be created in various ways, and not just in a single specific way. The crucial factor is that a sufficient proportion of democratic legitimation, or a specific level of legitimation, is achieved. The adequate level of legitimacy could be a balance of functional, institutional, personnel and material elements of legitimation. This paper tries to analyze the conception of „level of democratic legitimacy,“ which was developed by E. W. Böckenförde and the judgment of the German Constitutional Court. Several modes of democratic legitimation have been discussed. | |
