摘要 西雅圖會議在無法如期達成共識的情況下宣告暫時中止,不但新議題之諮商無法在二千年展開,連內建談判(built-inagenda )如農業、服務貿易進一步自由化之談判也蒙上不確定之陰影。漸進式自由化乃GATS 之特色之一,故第十九條規定,WTO 成立後五年起應陸續展開數回合之談判,以達進一步自由化,此即所謂的內建談判。雖然遠自西雅圖部長會議籌備階段,己開始GATS 內建談判之規劃,但會員國立場始終分歧。截至今日,卡達部長會議召開在即,各國迎接新回合的準備雖已較當年西雅圖時來得進步,但各國是否能克服歧異,使服務貿易談判有具體進展,仍未可知。本計畫追蹤西雅圖會議後、卡達部長會議前之服務貿易談判發展,舉凡內建議題談判(包括GATS 第六條第四項、政府採購、補貼、緊急防衛等之規則建立談判),以及與「GATS 十九條之特定承諾談判」有關之談判,均加以探討,以做為我國入會後積極參與WTO 之服務貿易談判之參考。
The WTO Seattle Ministerial Meeting was suspended due to failure to reach consensus within the set timeframe. Consequently, not only the new round of trade negotiation could not be launched timely in year 2000 for lack of agreed agenda in it, the future of the built-in negotiations, i.e. agriculture and trade in services, was also shadowed. Progressive liberalization is one of the important features of the GATS. It mandates in Article XIX successive rounds of negotiations, beginning not later than five years from the date of entry into force of the WTO Agreement and periodically thereafter. This is so-called built-in negotiation. The preparatory work for the GATS built-in negotiation commenced long before the Seattle Ministerial Conference, but the positions of members have always been very divergent. At this juncture, while the Qatar Ministerial Meeting is upcoming and the positions of members are advanced than where they stood in Seattle, it is still unpredictable whether members can forego their difference and make substantial progress in services trade negotiations. This study follows closely the post-Seattle Meeting negotiations on trade in services up to the Qatar Meeting. It puts equal weights on the two parallel negotiations: one is the rule-making track, including the talks under GATS VI:4, development of rules for Government Procurement(GATS XIII), Subsidies (GATS XV), and Emergency Safeguard (GATS X), and the other is the negotiation for specific commitments under GATS XIX. The study analyzes various positions presented during this period and propose some initial positions our authorities may take in the on-going negotiation after our accession to the WTO.
