題名 榮民與僑生法制所體現之公民身分認同

摘要 本研究擬針對1949-2004間,中華民國法律制度如何對待、看待兩種身分的人—從大陸遷徙來台的「榮民」,以及(以東南亞為主)「僑生」—進而分析憲法如何定位台灣、國家、公民等概念。 來自中國的「榮民」,在這段過程中歷經不同時期的身分認同與轉換:從暫居到生根;從外人到國民,又因為本土化或去中國化的趨勢而有著被當成外人的感覺。至於「僑生」,由於有著不同類型的身分—具有中華民國護照的無戶籍國民,有中華民國血統但沒有中華民國的「華裔」,或是應屬中華民國國民但欠缺證件的國民—法律上也因此有著不同的處理方式。隨著國際與國內政治局勢的改變,國家法律是否、如何將他們是為國家成員的「公民」,就是一個重要的議題。 本研究於第一年進行有關僑生法規與政策的研究;第二年進行榮民法規與政策的研究。第三年則依據前兩年整理之發現與資訊,發展出一套理論,說明「法制如何『反映或/並引導』國族認同與公民身分界定」。
This project studied how the R.O.C. legal system treat and view the two groups of people—Chinese veterans moved to Taiwan and the Southeast Asian overseas students, and then analyzes how the Constitution define the notions such as Taiwan, Nation, and citizenship during 1949 -2004. Veterans from Mainland China have been experiencing various identities and the transformation thereof in this era: from temporary to permanent residency; from outsiders to natives. Moreover, due to the t rend of “localization” or “de-Chinalization” after 1990, some of them felt that they were treated like aliens. With respect to overseas students, they have various identities—nationals without the Taiwan household registration, ethnic Chinese without R.O.C. national i t y, or nationals without identification documents. The law has different treatment accordingly. Whether and how the Taiwan law deems them “citizens” in the changing international and national political situations is thus a critical issue. This project plans to study the laws and policies regarding overseas students in the first year, to research the laws and policies about Chinese veterans in the second year; and therefore develops a systematic theory explaining “how the national law ‘ reflects or/and leads ’ national identity and the definition of citizenship. ”
