摘要 「違章建築」一詞往往令人聯想到落後國家。但臺灣是個已開發國家,立有建管法規規範以及相關政府機關管理。於此之下,違章建築現象仍是遍布各地區,甚至因長久的存在而形成特殊街道景觀,此可謂都市發展上的問題。在近年多起嚴重的公共安全事件發生下,也引起政府與民眾逐漸重視此議題。
本研究以1983年至2012年之臺北市違章建築查報資料為基礎,歸納查報違章建築的型態及特徵。結果顯示,臺北市以水平增建違建為多數,且隨著年份推近,建物專有部分違建的比例增加,高單價建材之違建比例減少。再者,本研究以里為分析單元,利用1999至2012年之資料,透過追蹤資料迴歸模型(panel data regression model)及多元線性迴歸模型探討影響臺北市各里違章建築查報之社會、經濟等影響因素。實證結果發現,管理委員會為重要的影響因素,且在公告現值較高和較新興的里,違章建築查報數量固定較多。
最後,本研究以羅吉特模型(logit model)分析促使政府處理查報後違建之因素。實證結果顯示,政府對於具有水平增建性質,或是屬於拆後重建和新違建類型的違建,採取較積極的處理態度。於政策和實際執行上,政府是一致採納遏止新違建產生的作法。
"Illegal building" is often associated with the least developed countries. While Taiwan is considered a developed country, with existing building laws and related government agencies regulating the industry, illegal buildings are still spreading over various regions. This case can be described as an urban development issue. With a number of serious public security incidents in recent years, increasing importance have been attached to the issue of illegal buildings.
This study summarizes the patterns and characteristics of reported illegal buildings based on the data of reported illegal buildings in Taipei City from 1983 to 2012. The results show that there were a large number of horizontal extensions of illegal buildings in Taipei City. As time went on, the percentage of illegal individual units increased, and the proportion of illegal buildings of high-priced materials decreased. In addition, this study uses the data from 1999 to 2012, via regression models to explore factors affecting the reported number of illegal buildings per village. The empirical results show that the management committee is an important influence factor, and the villages where are more newly developing or higher current land value, the number of reported illegal buildings is higher.
Lastly, this study uses logit model to analyze the factors that prompted the government to deal with illegal buildings after the investigation. The empirical results show that the government adopts a more active attitude towards the illegal buildings of horizontal extensions or the reconstructions, and new illegal buildings. The results also point out that in terms of policy and actual implementation, the government has consistently adopted the practice of curbing the emergence of new illegal buildings.
