| dc.description.abstract (摘要) | 根據憲法，我國政治運作的重心應是立法院和行政院，惟由於我國的憲政設計忽略了政黨的角色，致使實際的憲政運作會在內閣制與總統制之間擺盪。當立法院多數黨黨魁出任行政院長時，制偏向內閣制；如果出任總統，中央政府的體制則會偏向總統制。職是之故，關於憲政體制之定位，除了從憲法條文理解外，恐怕尚須從政黨政治與實際憲政的運作來思考，方能作出適當的解釋。總統直選與否，對憲政體制並無影響。 | - |
