| dc.description.abstract (摘要) | 自20世紀初以來，國際間即出現禁止奴隸之反對浪潮，1904年禁止販賣白奴國際協定、1910年禁止販賣白奴國際公約、1926年禁奴公約等國際協定及公約，到2000年首個重視現代人口販運議題之打擊人口販運議定書，清楚定義人口販運，連帶的也促使美國制定人口販運被害人保護法、歐盟制定2002年打擊人口販運框架決議、2005年打擊人口販運行動公約以禁止隨著全球化使人口販運更為猖獗之問題。我國於2009年制定人口販運防制法，起因於我國經美國國務院每年做出之人口販運報告自2005年起將我國評比為第二列，參考打擊人口販運議定書及美國TVPA而制定，又我國在未制定人口販運防制法前，於刑法、勞動基準法等法即有就人口販運被害人遭剝奪之意思、行動自由之規範得以適用，從而有必要自國際公約及比較法之角度分析人口販運之行為類型，檢視我國法之規範是否足以因應堪稱現代奴隸體現之人口販運。而我國於制定人口販運防制法後，就人口販運行為則同時有刑法、勞動基準法、人口販運防制法可資適用，亦有必要探討各法規之保護法益，釐清各法律間之競合關係，並檢討我國實務判決於論述人口販運行為如何適用法條並提出批判，最後提出修法建議，希冀我國於人權保障及打擊人口販運之議題得更符合世界趨勢。 | zh_TW |
| dc.description.abstract (摘要) | Since the early 20th century, a wave of opposition to slavery has emerged worldwide. For instance, “International Agreement for the Suppression of the White Slave Traffic ”in 1904, “International Convention for the Suppression of the White Slave Traffic ” in 1910, “Slavery Convention” in 1926, and “Protocol to Prevent, Supports, and Punish Trafficking in Person, Especially Women and Children, Supplementing the United Nation against Transnational Organised Crime” in 2000 which is the very first protocol concentrating on the fight against human trafficking. “Protectol to Prevent, Supports, and Punish Trafficking in Person, Especially Women and Children, Supplementing the United Nation against Transnational Organised Crime” define the meaning of human trafficking precisely, and that advances the enactment of “Trafficking Victims Protection Act of 2000” (TVPA) in the United States , “the Council Framework Decision of 19 July 2002 on Combating Trafficking in Human Beings” in European Union, and “the Council of Europe Convention on Action against Trafficking in Human Beings” in 2005 in European Union. The enactments above are all actions coping with the rampant crime of human trafficking due to globalization.As being ranked as Tier 2 in the annual “Human Trafficking in Persons Report” published by U.S. department of States since 2005, Taiwan has enacted Human Trafficking Prevention Law in 2009 referred to the “Protectol to Prevent, Supports, and Punish Trafficking in Person, Especially Women and Children, Supplementing the United Nation against Transnational Organised Crime” and “TVPA”. However, in the time before Human Trafficking Prevention Law is enacted , Criminal law, Labor Standards Act and other laws in our country have regulated the crime of deprivation of freedom of movement and expression of intent already. Therefore, it is necessary to analyze all sorts of human trafficking crime with the reference of international conventions and comparative laws. With this research, we may inspect our regulations against human trafficking are sufficient or not . And still, discussions on legal interests and applicable relations among all the regulations are concerned in this thesis. Moreover, studies and criticisms on the verdicts relating to human trafficking are also noted as well. In the end, the author will propose the suggestions for amendmends in the future to integrate the protection of human rights and the fight against human trafficking crime in Taiwan. | en_US |
