Other Transaction日期 2021 上傳時間 4-Aug-2021 15:44:25 (UTC+8) 摘要 為提升國家科學技術水準，促進整體產業發展，有待政府與產業界投入科學技術創新之研究發展。而政府採購已被廣泛認同為可有效引導創新思維與技術之策略工具，近年來許多國家亟思改善及優化政府採購之政策，如歐盟對於創新採購之推動與實踐有完整的政策規劃，於歐盟之研究與創新框架計畫「Horizon 2020」及後續「Horizon Europe」中均投入資金資助政府部門所進行之創新採購；嗣為改善原政府採購程序過於僵化繁複等問題，於2014年正式公布新版政府採購指令取代舊指令。另美國OT模式，制度設計係為突破FAR之繁複程序及限制而設，以獲取尖端科學技術之研究發展成果，與我國科研採購為增加更多制度彈性而立法排除採購法適用之立法方式亦有類同之處。本文將聚焦於我國採購法及科學技術基本法規中之研究發展採購類型，透過分析歐盟採購指令、創新採購指引，並研析已將歐盟新版政府採購指令國內法化之芬蘭政府實務作法，以及美國OT模式相關作業指引，結合國內部分實務案例，嘗試在我國科學技術研究發展採購之現有法制下，探討借鏡歐盟創新採購機制及美國OT新創採購模式之可行性，並提出可精進之修法與執行方向建議。本研究主要結論為思考將研究發展性質採購排除採購法適用之可能等，此外，本文並從政府政策、法規、採購實務等層面提出相關看法與建議。
In order to improve national science and technology and promote the development of the overall industry, research and development of science and technology innovation in the industry are needed. Government procurement has been widely recognized as a strategic tool that can effectively guide innovative thinking and technology. In recent years, many countries have been eager to improve and optimize government procurement policies. For example, the European Union has a complete policy plan for the promotion and practice of innovative procurement, and the European Union’s research and innovation framework project "Horizon 2020" and subsequent "Horizon Europe" have invested funds to fund innovative procurement by government departments; Immediately afterwards, in order to improve the original government procurement procedures that were too rigid and complicated, a new version of the government procurement directive was officially announced in 2014 to replace the old one. In addition, in the "Other Transaction", the system design is designed to break through the complicated procedures and restrictions of FAR in order to obtain the research and development results of cutting-edge science and technology. It is also similar to the legislative method of my country`s scientific research procurement in order to increase the flexibility of the system and exclude the application of the procurement law.This study will focus on the R&D of procurement types in my country`s procurement law and basic science and technology regulations. Through the analysis of EU procurement directives, innovative procurement guidelines, and related operating guidelines of the US OT model, we will try to explore foreign laws and regulations under my country’s existing legal system. The feasibility, and put forward suggestions for refinement methods and implementation directions that can be refined.The main conclusion of this research is to consider the possibility of excluding the application of the procurement law from research and development procurement. For example, the European Union has a complete policy plan for the promotion and practice of innovative procurement, and the European Union’s research and innovation framework project "Horizon 2020" and subsequent "Horizon Europe" have invested funds to fund innovative procurement by government departments; Immediately afterwards, in order to improve the original government procurement procedures that were too rigid and complicated, a new version of the government procurement directive was officially announced in 2014 to replace the old one. In addition, in the "Other Transaction", the system design is designed to break through the complicated procedures and restrictions of FAR in order to obtain the research and development results of cutting-edge science and technology. It is also similar to the legislative method of my country`s scientific research procurement in order to increase the flexibility of the system and exclude the application of the procurement law.This study will focus on the R&D of procurement types in my country`s procurement law and basic science and technology regulations. Through the analysis of EU procurement directives, innovative procurement guidelines, and related operating guidelines of the US OT model, we will try to explore foreign laws and regulations under my country’s existing legal system. The feasibility, and put forward suggestions for refinement methods and implementation directions that can be refined.The main conclusion of this research is to consider the possibility of excluding the application of the procurement law from research and development procurement.
