摘要 本文旨在以比較法之觀點,討論公平待客原則目前在我國監管制度與規範之發展。本文擬先介紹公平待客原則之內涵與發展背景,並比較英國、澳洲與台灣之監理模式。討論範圍包含國際保險官監理協會於 2019 年底公布之最新版本保險核心原則中與公平待客原則相關之條文。再者,本文對財團法人金融評議中心之相關案件進行整理與分析,以探索實務適用之情形,並彙整學者之意見與評論。最後,本文針對公平待客原則之內涵、定位、位階與效力提出見解。期盼本文能對改善現行架構與實務爭議能有所助益。
The purpose of this article is to analyze the development of Treating Customers Fairly Principle (TCF) in Taiwan’s regulatory system and regulations in comparative law perspective. This paper will begin with the introduction of content and background of TCF, also comparing regulatory systems of the U.K., Australia, and Taiwan. The discussion will cover regulations related to TCF in Insurance Core Principles released by International Association of Insurance Supervisors in 2019. After that, we will summarize and analyze the cases of Financial Ombudsman Institution to clarify its application issue, followed by further analysis of comments of scholars in Taiwan. Finally, we provide suggestions for the content, status, hierarchy, and effect of TCF. Hopefully, this paper can contribute to improve its framework and solve practical issues.
