摘要 理財專員藉由長期服務客戶所獲得的信賴感,利用銀行制度的漏洞盜領客戶資金,不僅是個人違法行為,也嚴重傷害民眾對於金融機構的信任,對於金融體系的政策實有相當大的傷害。金融監督管理委員會於2019年頒佈理專十戒,藉以提醒理財專員及客戶,遵守相關規定,勿讓理財專員的不當行為讓客戶的資產處於危險之中。
     
     本研究觀察,近五年來理財專員涉案的比例大幅爆發,平均每兩個月就有一件被定案,且銀行被裁罰的案例中,舞弊案例黑數還更多,也造成許多民眾將資金及金流服務轉為非傳統銀行體系,長期下來逐漸減少對銀行體系的依賴,當務之急必須扭轉一般民眾對於銀行的不信任感。
     
     有鑑於此,金融監管機關到銀行體系制定許多查核新措施,利用新型態的網路科技,及電子化的交叉比對技術,擺脫既有的紙本及影像稽核方式。本文蒐集具代表性的實際案例,從發生舞弊案件環境背景,至銀行後續的因應方式做案例式整理。除探討弊案之形成原因,作為防範未然參考,並詳錄監理機關及各家銀行業者的查核重點和提出建議。
Many wealth management specialists use the loopholes in the banking system to steal customers` funds by virtue of the trust they have gained from serving customers for a long time. This is not only an illegal act of individuals, but also seriously hurts the public`s trust in financial institutions and the government`s desire to stabilize the financial system. policy has done considerable harm. In 2019, the Financial Supervisory Commission promulgated the Ten Commandments for Management Professionals, in order to remind wealth management professionals and clients to abide by relevant regulations and not let the improper habits of wealth management professionals put clients’ assets at risk.
     
     According to the observation of this research, in the past five years, the proportion of financial professionals involved in cases has exploded. On average, one case is finalized every two months and the bank is punished. There must be more fraud cases that have not been exposed. Disappointing with the high ethical standards of banks, it has also caused many people to turn their money and cash flow services to tech players in a non-traditional banking system. In the long run, the dependence on the banking system will be gradually reduced, which will also lead to the continuous loss of excellent financial talents.
     
     In view of this, from the government`s financial regulatory authorities to the banking system itself, they have all worked together to prevent fraud cases, and have formulated many new inspection measures. They have also made use of new types of network technology and electronic cross-sections. This paper collects representative actual cases for discussion, from the environmental background of fraud cases to the follow-up response methods of banks to do case-style sorting. In addition to discussing the reasons for the formation of the fraud, as a reference to prevent it from happening, it also records the inspection priorities and suggestions of the supervisory authority and each banker.
