題名 土地使用分區制度之經濟分析

摘要 於私有財產權制度下,私人土地使用分區制度與私人契約等非正式制度為何未能使人們的土地使用脫離自然狀態或囚犯困局?由政府決策與執行之土地使用分區制度之產生背景與原始之基本理念為何?是本文嚐試探討與釐清的課題。由於土地使用分區制度之專業規劃過程所憑藉的是財產權的界定或弱化,其政治過程所角力的是財產權的內涵,故基於財產權觀點,本文再探討土地使用分區制度為何能持續存在的原因。經由上述分析分析結果,本文進一步討論土地使用分區制度與市場機制之關係。
Under private properties, why cannot the informal institutions such as private zoning association and private contract help land uses to escape from the natural state or prisoners` dilemma? What are the emergence of the background and original basic concept of zoning institution? The above issues will be investigated and examined respectively. Besides the technocratic processes, the decision making and enforcement of zoning institution involve political process. The technocratic processes are based on the definition or attenuation of property rights and the political processes bargain for the characteristics of property rights. From the viewpoint of property rights, the reasons why zoning institution persists are provided. Finally, the relationships between zoning institution and market mechanism are further discussed.
