摘要 當代自由民主憲政國家，以國民主權原則作為憲法核心價值，強調國家的意志與權力來自於人民，並保障人民政治參與的權利。其中，投票作為人民行使各項參政權的典型與基礎，乃民主制度所不可或缺，故除了在各國的憲法多有明文對投票權的保障外，國際人權法也將之作為基本人權。

在投票權的保障內涵中，一人一票的普通原則乃是最基本的要求，惟對於精神與智能障礙者而言，他們的投票權卻長期受到普遍剝奪。其剝奪理由，不外乎是認為他們不具備理性思考能力，無法嚴謹審慎地評估自己所為的決策，難以與其他公民一起合作形成國家或公共事務的決定；抑或是，擔憂他們容易受到不當操控與影響，進而減損了民主投票的完整性與確實性。因此，不論是在政治哲學、各國法規範，或國際人權法的脈絡中，剝奪精神與智能障礙者的投票權常被視為正當合理。

然而，對此情形，聯合國於2006年通過的《身心障礙者權利公約》儼然成為扭轉的關鍵。透過該公約對身心障礙者融合社會價值的強調，及對平等規範內涵的重構，精神與智能障礙者「平等參與政治」的圖像逐漸顯現。同時，該公約所具有的規範效力，也對各締約國的法制產生一定程度的指引，除了促使對精神與智能障礙者主體性與權利觀的反思，更在投票權的保障實踐上，呈現嶄新的人權趨勢。

本文旨在研究《身心障礙者權利公約》對於精神與智能障礙者投票權的保障。除解析該公約對投票權保障的規範內涵，亦透過比較觀察歐洲區域內司法裁判與法制變遷，針對過往排除精神與智能障礙者投票權的觀點與法規範重新檢討，並探求該等公約保障於我國法體系中加以落實的具體途徑及作法。

dc.description.abstract (摘要) 當代自由民主憲政國家，以國民主權原則作為憲法核心價值，強調國家的意志與權力來自於人民，並保障人民政治參與的權利。其中，投票作為人民行使各項參政權的典型與基礎，乃民主制度所不可或缺，故除了在各國的憲法多有明文對投票權的保障外，國際人權法也將之作為基本人權。

在投票權的保障內涵中，一人一票的普通原則乃是最基本的要求，惟對於精神與智能障礙者而言，他們的投票權卻長期受到普遍剝奪。其剝奪理由，不外乎是認為他們不具備理性思考能力，無法嚴謹審慎地評估自己所為的決策，難以與其他公民一起合作形成國家或公共事務的決定；抑或是，擔憂他們容易受到不當操控與影響，進而減損了民主投票的完整性與確實性。因此，不論是在政治哲學、各國法規範，或國際人權法的脈絡中，剝奪精神與智能障礙者的投票權常被視為正當合理。

然而，對此情形，聯合國於2006年通過的《身心障礙者權利公約》儼然成為扭轉的關鍵。透過該公約對身心障礙者融合社會價值的強調，及對平等規範內涵的重構，精神與智能障礙者「平等參與政治」的圖像逐漸顯現。同時，該公約所具有的規範效力，也對各締約國的法制產生一定程度的指引，除了促使對精神與智能障礙者主體性與權利觀的反思，更在投票權的保障實踐上，呈現嶄新的人權趨勢。

本文旨在研究《身心障礙者權利公約》對於精神與智能障礙者投票權的保障。除解析該公約對投票權保障的規範內涵，亦透過比較觀察歐洲區域內司法裁判與法制變遷，針對過往排除精神與智能障礙者投票權的觀點與法規範重新檢討，並探求該等公約保障於我國法體系中加以落實的具體途徑及作法。		zh_TW
