2019年立法通過的《電信管理法》，已逐步取代既有的《電信法》，成為電信產業的新法規框架。但是，在檢視我國通訊傳播匯流法制發展歷程時，發現通傳會近年在推動通訊傳播匯流法制的策略和理路已趨於凌亂，同屬通訊傳播匯流法制架構一環的傳播法制，其修正方向和策略未見明朗。

為提出適當且可行的管制框架，本研究以視聽媒體平臺為研究核心，採法政策學取向，並參考歐盟與美國通訊傳播法制發展歷程，分別從政策原則、法制架構、結構與行為規範等三部分，解析我國通訊傳播匯流法制中的傳播營運管理層，與基礎網路層、電信營運管理層，以及內容應用層之間的管制爭議。

本研究建議，視聽媒體平臺管制框架應採行三項設計原則：（1）採通訊、傳播二元管制；（2）以「視聽媒體平臺服務」的概念涵蓋既有和新視聽媒體平臺服務；（3）依編輯責任高低決定視聽媒體平臺管制強度。至於視聽媒體平臺管制框架結構，建議依一般、特別，以及指定義務的模式規範。此外，在放寬既有廣電服務管制同時，輔以建立視聽媒體平臺產業自律組織，以產業自律做為管制第一道防線，接著才是政府法律規範，透過產業、公民團體以及政府等多方利害關係人共同參與，型塑數位匯流管制模式，這亦是網路治理精神下，對視聽媒體平臺管制應有的架構和格局。
Abstract

The legislation of the Telecommunications Management Act in 2019 has become the new legal framework for telcos and gradually replaced the existing Telecommunications Act. However, in reviewing the evolvement of the communications convergence regulatory framework in Taiwan, the strategy and rationale of the NCC in proposing the draft bills have become messy and unclear in recent years.

The thesis aims to suggest an appropriate and feasible regulatory framework for audiovisual media platforms by adopting the approach of legal policymaking. Comparing the communications regulatory frameworks in the EU and the US, the thesis deconstructs the regulatory issues of three layers of infrastructure networks, operation and management, and content application in Taiwan.

The thesis suggests that the regulatory framework for audiovisual media platforms should consider three principles: (1) to adopt the principle of dual regulation of telecommunications and broadcasting; (2) to introduce a concept of "audiovisual media platform services" to cover both existing and new audiovisual media platform services; (3) to determine the regulatory intensity toward the audiovisual media platforms according to the level of editorial responsibility. The thesis suggests following the general, special, and designated obligations model to construct the regulatory framework for audiovisual media platforms.

In addition, while relaxing the regulations of the existing broadcasting services, it is necessary to establish a well-functioned industrial self-regulation organization for audiovisual media platforms. To shape a sound regulatory mechanism in the digital age, law and regulation enforcement is the last measure to take after the industrial self-regulation and the co-regulation with the participation of the stakeholders, including the industry, the civic groups, and the government. The mechanism is also the spirit of Internet governance.

2019年立法通過的《電信管理法》，已逐步取代既有的《電信法》，成為電信產業的新法規框架。但是，在檢視我國通訊傳播匯流法制發展歷程時，發現通傳會近年在推動通訊傳播匯流法制的策略和理路已趨於凌亂，同屬通訊傳播匯流法制架構一環的傳播法制，其修正方向和策略未見明朗。

為提出適當且可行的管制框架，本研究以視聽媒體平臺為研究核心，採法政策學取向，並參考歐盟與美國通訊傳播法制發展歷程，分別從政策原則、法制架構、結構與行為規範等三部分，解析我國通訊傳播匯流法制中的傳播營運管理層，與基礎網路層、電信營運管理層，以及內容應用層之間的管制爭議。

本研究建議，視聽媒體平臺管制框架應採行三項設計原則：（1）採通訊、傳播二元管制；（2）以「視聽媒體平臺服務」的概念涵蓋既有和新視聽媒體平臺服務；（3）依編輯責任高低決定視聽媒體平臺管制強度。至於視聽媒體平臺管制框架結構，建議依一般、特別，以及指定義務的模式規範。此外，在放寬既有廣電服務管制同時，輔以建立視聽媒體平臺產業自律組織，以產業自律做為管制第一道防線，接著才是政府法律規範，透過產業、公民團體以及政府等多方利害關係人共同參與，型塑數位匯流管制模式，這亦是網路治理精神下，對視聽媒體平臺管制應有的架構和格局。		zh_TW
dc.description.abstract (摘要) Abstract

The legislation of the Telecommunications Management Act in 2019 has become the new legal framework for telcos and gradually replaced the existing Telecommunications Act. However, in reviewing the evolvement of the communications convergence regulatory framework in Taiwan, the strategy and rationale of the NCC in proposing the draft bills have become messy and unclear in recent years.

The thesis aims to suggest an appropriate and feasible regulatory framework for audiovisual media platforms by adopting the approach of legal policymaking. Comparing the communications regulatory frameworks in the EU and the US, the thesis deconstructs the regulatory issues of three layers of infrastructure networks, operation and management, and content application in Taiwan.

The thesis suggests that the regulatory framework for audiovisual media platforms should consider three principles: (1) to adopt the principle of dual regulation of telecommunications and broadcasting; (2) to introduce a concept of "audiovisual media platform services" to cover both existing and new audiovisual media platform services; (3) to determine the regulatory intensity toward the audiovisual media platforms according to the level of editorial responsibility. The thesis suggests following the general, special, and designated obligations model to construct the regulatory framework for audiovisual media platforms.

In addition, while relaxing the regulations of the existing broadcasting services, it is necessary to establish a well-functioned industrial self-regulation organization for audiovisual media platforms. To shape a sound regulatory mechanism in the digital age, law and regulation enforcement is the last measure to take after the industrial self-regulation and the co-regulation with the participation of the stakeholders, including the industry, the civic groups, and the government. The mechanism is also the spirit of Internet governance.		en_US
