dc.description.abstract (摘要) | This article discusses AtriCure, Inc. v. Jian Meng,2 (AtriCure II) wherein a surgical device innovator successfully won a preliminary injunction to enjoin its Chinese distributor from using alleged trade secrets worldwide. AtriCure II indicates that extraterritorial injunction is an option for preventing a foreign distributor from misappropriating trade secrets in the distributor`s country. AtriCure II indicates that use of trade secrets may be proved by showing that the products of the plaintiff and defendant are very similar. Lastly, the process of the plaintiff timely dissociating itself from the defendant is what other innovators in the medical device industry can learn. | |
