Mysticism日期 2022 上傳時間 5-Oct-2022 09:06:31 (UTC+8) 摘要 沃格林(Eric Voegelin)認為法律規範性的來源是「本體論上的應然」(Ought in the ontological sense),或者說是⼈在超驗的真正秩序與經驗的⼈造秩序之中體驗到的張⼒。這樣的法哲學建⽴在⼀種哲學⼈類學之上,將⼈看作在超驗與經驗、彼世與此世之間的存有。⼈因來⾃超驗端的牽引,⽽體驗到規範性。這樣的法哲學是神祕主義的。此外,只有根植於超驗與經驗之間的神祕主義法哲學,才能正當地導引⼈對於絕對之物的追求。藉此,它避免法秩序衰敗為沃格林稱為「諾斯替主義」的失序,進⽽⾛向極權主義的悲劇。
Eric Voegelin considers the source of the normativity of law to be “Ought in the ontological sense”, or the tension experienced by man between the transcendental true order and the empirical man-made order. A legal philosophy of this kind presupposes a sort of philosophical anthropology that treats a human as a being between transcendence and mundanity. Man is guided by the Transcendent, and hence he experiences normativity. Such a philosophy of law is mystical. Furthermore, only a mystical philosophy of law based between transcendence and mundanity can rightfully guide man’s pursuit of the Absolute. Thereby, it prevents the legal order from decaying into disorder which Voegelin names Gnosticism and eventually collapsing into the tragedy of totalitarianism.參考文獻 英文、德文部分Arnold, Eckhart (2007).
