Temporary reproduction日期 2022 上傳時間 2-Dec-2022 15:14:49 (UTC+8) 摘要 在數位科技的發展之下,著作的散布方式已漸漸和以往有所不同,不再僅仰賴光碟、紙本等載體的形式進行散布,而能透過數位化的方法,將創作之內容以數位格式先儲存於資料庫或網路伺服器中,再藉由網路傳輸至消費者的電腦裡,此為現行十分常見的數位著作物交易方式。本文欲探究此類透過網路傳輸之無體數位著作物 是否得如同有體數位著作物般適用權利耗盡原則,若有適用之必要,則就現行法下無體數位著作物於轉售交易時遭遇的爭議難題,本文亦將提出相應之解決作法,以期能重建無體數位著作物的合法二手市場。
As digital technology develops, copyrighted works could distribute through different ways, in addition to distributing by CDs and physical books, they could be transferred to digital content and stored in the online server, then downloaded to consumers’ computer by digital transmission, which is a common approach to purchase digital copies recently.
