Summary | 依農業發展條例第18條規定,於一定要件下,得容許農業用地供作興建農舍(個別農舍及集村農舍)使用。且同條第5項並就興建農舍之農民資格、最高樓地板面積、農舍建蔽率、許可條件、申請程序等相關事項,授權內政部會同行政院農業委員會訂定「農業用地興建農舍辦法」(下稱「興建農舍辦法」)。 Article 12, paragraph 2 of the Regulations for Agricultural Lands Constructing Farmhouse: “The agricultural land that has been applied for the construction of farmhouses shall not be divided before the control of the cadastral map overlay is lifted.” The judgments of the courts are inconsistent on whether this provision exceeds the scope of authorization stipulated in Article 18, Paragraph 5 of the Agricultural Development Act. This article selects and explains several court decisions on this subject. |
