| dc.description.abstract (摘要) | 隨著社會整體環境改變、科技媒介之日新月異，對於影響國家安全的因素也與過往有所不同，除了傳統安全定義上的軍事威脅，非傳統安全領域亦越發重要。現今整體世界趨勢，在非傳統安全部份，已開始藉由網路戰、輿論戰及心理戰等「銳實力」滲透或誘拉手段，透過意識型態影響一國政策或是重要事件未來走向，甚至可能直接或間接的使政治情勢發生改變等。
「銳實力」源於美國智庫國家民主基金會於2017年12月提出的概念，其所代表的涵義有別於以藝術文化等交流的「軟實力」，或是以軍事、經濟為主要手段之「硬實力」，銳實力主要是藉由國家權力或是以境外隱蔽手段，企圖輸出其影響力，達到對特定國家滲透或製造混亂之目的。而面對於以有別於過往的銳實力威脅，我國法律雖不斷修正以強化維護國家安全防護網，然現行法律規範仍有可精進之處。為能有效控管境外勢力的影響，本文借鏡澳洲2018年頒布之《外國影響力透明化計畫法案》（Foreign Influence Transparency Scheme Act 2018），比較與我國法律差異之處，並提出我國未來可行建議，期望能使我國國家安全法制更加完善。 | zh_TW |
| dc.description.abstract (摘要) | With the overall change in social environment and the rapid evolution of technology, factors influencing national security are also different from those of the past. In addition to traditional sense of military threats, non-traditional security domains have become increasingly crucial. In the contemporary realm of non-traditional security, actors start to employ ”sharp power” tactics such as cyber warfare, public opinion warfare, and psychological warfare, or means of infiltrateion or inducement. By doing so, these actors intend to shape a country's policies, steer the course of major events through the manipulation of ideologies, or even change the political situation of a country, directly or indirectly.
The concept of “sharp power” was proposed by the National Endowment for Democracy, a US think tank, in December 2017. It is different from the concept of “soft power,” which involves artistic and cultural exchanges, or “hard power,” characterized by military and economic means. Actors exercise “sharp power” through state power or covert means in an attempt to export influence, so as to infiltrate or provoke turbulence in certain countries. Faced with the unprecedented threat of “sharp power” although Taiwan has continuously amended its laws to strengthen the protection of its national security, there is still room for improvement. To effectively cope with the influence of foreign forces, this article draws on Australian Foreign Influence Transparency Scheme Act 2018 and compares it with Taiwan's laws. It also puts forward feasible suggestions for Taiwan's future legal system, hoping to enhance the national security legal framework. | en_US |
