Institutionalization of Party in the Legislative Yuan

摘要 國會作為去解決社會上衝突的代議機制,勢必面臨Wilson(1999)所指出的三個問題--協調、集體行動與集體選擇,國會必須適當地建立起組織與程序,有效解決上述三個問題,才能發揮制度設計上應有的功能。從1980年代中期民主化以來,立法院逐漸脫去橡皮圖章的角色,在立法過程中逐漸積極自主,並在許多重要法案上逐漸展現影響力。然而,在立法院中卻屢屢上演衝突事件。值得我們去檢視立法院是否已適當地建立起組織與程序,且立法院內的主要行動者是否建立共識,同時,一般民眾對這些組織與程序的認知與評價如何。近年來,有許多討論新興民主國家國會制度化的研究,然而,對臺灣國會制度化的討論卻極為有限,且即便過去對立法院改革的論著不少,但並無以制度化的角度來探討此一問題。 本研究計畫擬以國會政黨體系制度化的角度,探討立法院與各自政黨如何建立組織與規則去處理立法院中黨際與黨內的衝突,並且評估這些組織與規則,是否達成效果,並檢視立法院內成員是否達成共識,此外,並檢視一般民眾對這些組織與規則的認知與態度,我们相信對這些組織與程序的共識與認同,將有助於組織與程序的穩定。 此計畫將進行兩年,第一年將蒐集立法院正式與非正式的組織與規則,並作立委訪談與立委助理調查,以了解相關的組織與程序,以及了解立委對這些組織與程序的態度;第二年首先對20個重大法案進行深入的個案分析,並且輔以立委深入訪談,以了解組織與程序對於處理立法院歧見與衝突的效果,此外並透過一般民眾的焦點團體座談會,以實際明瞭一般民眾對於立法院處理衝突的組織與規則的理解與評價。最終將透過質化與量化資料合併分析,理解臺灣立法院政黨體系的制度化程度。本計畫除能跟上國際學術社群討論國會制度化的腳步,也能彌補對臺灣立法院制度化研究的文獻不足的缺憾,最後,期望藉由此科學性與系統性的研究,提供日後國會制度改革的參考。
As representative institutions, legislatures are designed to deal with conflicts. As Wilson (1999) convincingly points, legislature must build up organizations and procedures to grapple with three problems: coordination, collective action, and collective choice. Responding to the democratization in the beginning of the mid-1980s, Taiwanese legislature has evolved from being rubber-stamper to being more active and autonomous in the legislative process. The Legislative Yuan has shown greater influence in the policy-making process. However, many conflicts occurred in the Legislative Yuan. Although many academic discussions on parliamentary institutionalization in the newly democratic countries these days, it is rarely discussed on Taiwanese legislature. In addition, though some studies touch the issues of parliamentary reforms, they rarely discuss the reforms from the perspective of perspective of institutionalization From the angle of party system institutionalization in the Legislative Yuan, this project tries to explore how and how well the Legislative Yuan and individual parties builds up organizations and procedures to resolve inter-party and intra-party disputes, how well the insiders reach their consensus, and how the outsiders perceive and evaluate these organizations and procedures. We believe that the consensus of political elites and great evaluations of the public on these institutions will stabilize them and promote the institutionalization. This project will be conducted in two years. In the first year, we will first collect formal and informal organizations and procedures, and then interview legislators intensively, as well as conduct survey on assistants of legislators. In these ways, we may understand the organizations and procedures in the Legislative Yuan, and how political elites evaluate them. In the second year, we will first conduct case studies on 20 important bills, and followed by interviewing intensively on legislators involving these bills. In these ways, we may evaluate the effectiveness of these institutions. Then, nine focus group discussions will be convened. In this way, we may examine how the public perceives on the organizations and procedures, as well as its evaluations on the performance of individual parties and the Legislative Yuan as a whole. Finally, combining the qualitative and quantitative data in two years, this project may evaluate the level of the party system institutionalization of the legislative Yuan. On the one hand, this project will provide systematic observations on the institutionalization of the Legislative Yuan, and catch up the pace of the international academic discussions on the parliamentary institutionalization. On the other hand, this research may provide advices for the reforms on the parliamentary design on the basis of scientific and systematic research findings.
