| dc.description.abstract (摘要) | 此次研究計畫對於學術研究之貢獻，或許未如對國家發展所得成就者，無論就未來權宜船人權侵害防制與跨國求償訴訟實務而言。筆者預期提出權宜船條例之具體修正意見，納入企業與人權及境外管轄等機制。我國遠洋漁業近年無論於環境或人權議題上皆飽受批評，為此產業對我國具有戰略地位，包括入漁與邦交之間的連結以及國際組織的參與。此一產業面臨之挑戰，實得左右我國國際聲望與地位。環境與人權皆為當代產業經濟永續之要項，而權宜船之投資經營倘持續惡化我國遠洋漁業形象，不惟與我國企圖鞏固之人權法治相違悖，更是產業永續之首要障礙。 | |
