| dc.description.abstract (摘要) | 「消除對婦女一切形式歧視公約」國際審查會議在第4次的國家報告中指出，《民法》仍然保留了非婚生兒童被標記為非婚生兒童的貶義概念，並建議修訂《民法》，以消除非婚生兒童的概念，並保障所有兒童的平等權利，不論其父母的正式關係為何。根據此一要求，本研究計畫以德國、瑞士民法中有關非婚生子女規定的沿革與修法內容作為研究對象，並以我國與非婚生子女有關之學術著作進行分析與整理，盤點非婚生子女在我國之法律地位，同時以專家訪談的方式，了解對我國修正非婚生子女規範之必要性，最後提出在民法的父母子女章節中應如何去除婚生子女與非婚生子女之區別，以及在相關法規範，包括婚生推定、認領制度等，於實質內容上應如何調整，方能達到形式上與實質上的平等，落實兒童權利公約的不歧視原則。 | |
| dc.description.abstract (摘要) | “The Convention on the Elimination of All Forms of Discrimination Against Women” international review meeting pointed out in the fourth national report that the Civil Code still retains the derogatory concept of children born out of wedlock being marked as illegitimate. It recommends revising the Civil Code to eliminate the concept of illegitimate children and to ensure equal rights for all children, regardless of their parents' official relationship. In response to this request, this research project will focus on the evolution and legislative content regarding children born out of wedlock in the civil laws of Germany and Switzerland. It will also analyze and organize academic works related to children born out of wedlock in our country, inventorying the legal status of these children. Additionally, through expert interviews, the project will seek to understand the necessity of amending the regulations concerning children born out of wedlock in our country. Finally, it will propose how to remove the distinction between legitimate and illegitimate children in the parent-child chapter of the Civil Code and how to adjust relevant regulatory standards, including presumption of legitimacy and recognition systems, in order to achieve formal and substantive equality and to implement the non-discrimination principle of the Convention on the Rights of the Child. | |
