| dc.description.abstract (摘要) | 康德在《實踐理性批判》結語曾說，「當我們越是思索內心道德法則以及與此相呼應的人性尊嚴時，就會越發對它們提升自我人格的價值而不斷地予以讚嘆與敬畏。」經由康德道德哲學對人性尊嚴的反思，以及進而根據《判斷力批判》對人性尊嚴的讚嘆與敬畏，究竟能夠對於當代以人性尊嚴為基本價值的憲政秩序，包括台灣現行的自由民主憲政秩序在內，提供哪些價值反思？從而能否促進對這套自由民主憲政價值體系的信仰？本計畫預計探討重點在於人性尊嚴經由康德《判斷力批判》的反思，如何成為品鑑當代憲法價值秩序的基點？而此一問題的討論，首先必須釐清人性尊嚴在康德《實踐理性批判》與《判斷力批判》領域，各自強調的重點為何？兩者又有哪些體系上的關聯？最後才能據此討論經由《判斷力批判》的反思，會對於人性尊嚴在當代憲政價值秩序的定位產生哪些具體影響？ | |

The discussion of this issue must first clarify the relationship between Kant's "Critique of Practical Reason" and " Critique of Judgment". After that, we can learn about which concrete impacts of judgement will be put on the human dignity in the contemporary constitutional order? | |
